ARTICLE 2: APPLICABILITY & CONDITIONS

Our general terms and conditions apply to every offer from us as an online retailer to you as a consumer.
We only deliver in Belgium. If you provide a delivery address in another country, we can refuse your order.
You must be at least 18 years old to place an order. If you are not 18, we ask you to have the order placed by your parents or legal guardian. If we notice that an order has been placed by a minor, we can refuse this order.
Placing an order on our website is an explicit acceptance of our general terms and conditions of sale, which are always available via the website.
If you order online, we will also provide you with a copy of these terms and conditions together with the order confirmation or at the latest upon delivery in a format that you can save or print. We recommend that you always do this.

ARTICLE 3: OUR OFFER AND YOUR ORDER

If an offer has only a limited period of validity or is subject to certain conditions, we explicitly state this in our offer.
We always describe as fully and accurately as possible what we sell you and how the ordering process will proceed. In any case, the description is sufficiently detailed to allow you to make a good assessment. The images on our website are purely illustrative.
To purchase a product, add the product to your shopping cart. Afterwards you enter your contact details and billing information. Then choose your method of delivery: Collection. in the last step you will get an overview page, accept our terms and conditions and confirm your payment by pressing the order button with the caption “order with payment obligation”. Once you have completed these steps, your order is final.
However, the agreement between us is only final when we confirm your order by e-mail and as soon as we have received the approval of the card issuer for your payment transaction with credit or debit cards. We accept Bancontact. If the issuer of your card refuses to agree to your payment to us, we cannot be held responsible for delays in the delivery and / or non-delivery of your order. We do not accept or process orders without a valid payment in the name of the registered cardholder.
You can place orders up to 1 hour before closing time of our store. The opening hours are listed on this page.
If you want to cancel your order after placing your order, please contact us on 0499 297 810 or info@dalton-arts.com to discuss the possibilities.
Denzel Mettepenningen is entitled to cancel your order in case of force majeure, if the offer is not available or if your contact details prove to be incorrect or unreachable. If Denzel Mettepenningen cancels an order that has already been paid, Denzel Mettepenningen will immediately transfer that amount to the account from which the payment was made.

ARTICLE 4: RIGHT OF WITHDRAWAL

If you purchase goods or services from us, you have the right to decide that you do not want to keep the goods for 14 days from the delivery or conclusion of the contract. You can then return your order without paying a fine and without giving any reason (you pay the costs for this yourself). Within 14 days after we have received your order back. Or you have indicated that you want to cancel the agreement, we will refund you the full purchase price with the same payment method with which you paid.
The direct costs of returning the goods are therefore at your expense. We will indicate the cost or estimate if this cannot be reasonably calculated in advance. If the goods cannot be returned by post, we will collect them from you and you will not be charged for this.
We may wait with a refund until we have received the goods back Or until you have shown that you have returned the goods, whichever comes first.
During the first 14 days after delivery, we expect you to handle the order and packaging with care. If you still want to be able to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the goods. Returned goods may be appropriate, but may not have been used. If you return the goods, this should be done if possible together with the original packaging, with all accessories supplied and in the original condition and packaging and taking into account our instructions below.
You can return your return package by post or by courier.
To exercise your right of withdrawal, both in the case of delivery of services and delivery of goods, quickly and correctly, you can fill in the form below and send it to info@dalton-arts.com. We will send you a confirmation of your revocation by e-mail.

ARTICLE 5: THE PRICE

During the period that we mention in our offer, our prices do not change, except for price changes due to changes in VAT rates.
Our prices include all taxes, VAT, taxes and services. Additional delivery costs or other administrative costs are always reported before you place your order definitively. So you will never be faced with surprises.

ARTICLE 6: PAYMENT

We can only accept payment via the payment modules on our website.
To ensure a safe online payment and the safety of your personal data, the transaction data is sent encrypted with SSL technology over the internet. You do not need any special software to pay with SSL. You can recognize a secure SSL connection by the "lock" in the bottom status bar of your browser.

ARTICLE 7: CONFORMITY AND WARRANTY

We guarantee that our meals conform to your order and meet the normal expectations you may have. We also guarantee that our meals comply with all existing food safety laws and regulations at the time of your order.
If we also supply goods under your order that fall under the statutory two-year warranty, you are of course entitled to the warranty provided by law and the delivered goods will be repaired or replaced free of charge within the conditions of the law.

As far as possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive, impossible or cannot be carried out within a reasonable period of time, you have the right to demand a price reduction or the termination of the sales agreement.

ARTICLE 8: DELIVERY AND EXECUTION

After placing an order, you must be available by telephone and e-mail regarding the status of the order.
If you opt to collect the order, you must be present at the restaurant at the chosen time.
If you opt for the delivery of the order, you must be present at the address that you indicated when you placed the order.
Deliveries are made (TERM DELIVERY).

If we cannot deliver on time, we will always notify you before the scheduled delivery time has expired. If we do not do this, you can cancel your order free of charge. in that case we will refund you immediately and at the latest within 30 days after dissolution.
Our deliveries are always at our risk. So you don't have to worry about goods lost during delivery. The risk regarding the order passes to you after the order has been delivered.
The total liability of Denzel Mettepenningen due to an attributable shortcoming in the fulfillment of the agreement or for any other reason, is limited to compensation for direct damage up to a maximum of the amount of the price stipulated for that agreement.

ARTICLE 9: FORCE MAJEURE

in case of force majeure we are not obliged to fulfill our obligations. in that case we can either suspend our obligations for the duration of the force majeure or terminate the agreement definitively.
Force majeure is any circumstance beyond our control and control that prevents the fulfillment of our obligations in whole or in part. This includes, but is not limited to, strikes, fire, business failures, energy failures, failures in a (telecommunication) network or connection or used communication systems and / or the unavailability of our website at any time, not or not in time supply from suppliers or other third parties engaged, restrictive measures imposed by the government, viruses or disease waves or any other circumstance that makes it reasonably impossible for us to effectively deliver your order ....

ARTICLE 10: INTELLECTUAL PROPERTY

Our website, logos, texts, photos, names and generally all of our communications are protected by intellectual property rights which belong to us, our suppliers or other rights holders.
It is prohibited to use and / or make changes to the intellectual property rights as described in this article. For example, you may not copy or reproduce drawings, photos, names, texts, logos, color combinations, etc. without our prior and express written permission.

ARTICLE 11: COMPLAINT PROCEDURE AND DISPUTES

We always hope that all our customers are 100% satisfied. If you still have complaints about our services, you can contact us at info@dalton-arts.com. We do everything we can to handle your complaint within 7 days.
All agreements that we conclude with our customers, regardless of their place of residence, are exclusively governed by Belgian law and in the event of disputes, only the competent Belgian courts have jurisdiction. If, for reasons of international law, another law applies, the interpretation of the present general terms and conditions will firstly refer to the Belgian Code of Economic Law.
If we still can't work it out together, you can go to SafeShops as a consumer. SafeShops.be will mediate between the consumer and the seller if the complaint is well-founded at first sight.
